Dear Mr./Mrs. ___________________________

In connection with any understanding for the NFA to hire your service vehicle/s which
is of good running condition with:

We wish invite conformity to the following conditions:

I. DURATION:

This Letter-Agreement for service vehicle/s hired shall remain effective and operative
until _________________ unless sooner terminated by NATIONAL FOOD AUTHORITY
(NFA) three (3) days advance notice.

II. OBLIGATIONS OF SERVICE OWNER:

1. To provide service vehicle which are of good running conditio for purposes of transporting NFA employee's, rice/non-grains commodities or properties from one NFA warehouse to another warehouse or from/to any designated area within the jurisdiction of province , related to the operation of NFA;

2. To provide said service vehicle/s with competent driver/s who must be a holder of a professional driver's license and shall have the authority to sign supporting papers corresponding tot he service vehicles. The driver assigned and authorized to operate shall receive orders from duly authorized NFA representative in connection with assignments of such service vehicles;

3. To shoulder all expenses for repairs, minor or major as well as expenses for replacement of spare parts;

4. To equip the service vehicle/s at all time s with at least one (1) spare good tire available for use;

5. To bear all expenses for registration fees and other similar expenses such as wage of driver/s, oil and other pertinent matters regarding maintenance and operations of the service vehicles;

6. To provide sufficient cover for service vehicle/s which shall be used in case of heavy rains typhoons or any calamity of similar nature to protect NFA employees, properties (rice/non-grais commodities) transported or loaded;

7. The owner shall likewise provide fuel for the service vehicle/s that is utilized only for the said purpose.

III. OBLIGATIONS OF THE NFA:

1. Subject to the usual auditing and accounting procedures the NATIONAL FOOD AUTHORITY, thru its Provincial Manager concerned shall pay you ________________
________________________ (P____________________) per day to eight (8) hours daily which shall be supported with trip tickets properly accomplished by the driver/s, signed by the dispatcher and certified correct by the concerned Assistant Provincial Manager or any representative authorized to sign the same;

2. In excess of eight (8) hours, the NFA shall pay, you at _______________ (P______)
per hour.

3. In the event that you fail to render a full eight (8) hour/day service by reason of your own fault or negligence a corresponding reduction in the payments shall be made.

IV. OTHER SPECIAL CONDITIONS:

1. The NFA shall not be held liable for the loss of your service vehicle/s nor shall the NFA answer for its destruction/damages, deterioration or accident nor shall NFA be liable for any damages, physical injuries or death of your driver/s or any third person's caused by accident or force majeure;

2. The NFA shall not be liable for any infraction or traffic violation/s committed by your driver/s;

3. It is understood and mutually agreed that there is no employer-employee relationship between the NFA and your driver/s as much relationship exist between you and your driver/s;

4. The service owner shall be liable to his driver under the WCC, SSS, Medicare, Minimum Wage Law and other related labor laws and social legislation, rules and regulations. Further, he shall be deemed as an independent contractor under this Letter-Agreement;

5. The considering the very nature of this Letter-Agreement you shall exercise extraordinary diligence in carrying the said NFA-employees, non-grains commodities or properties from one NFA warehouse to another NFA office/warehouse or areas and/or vice versa within the jurisdiction of the __ province related to the operations of the NFA;

6. That this Letter-Agreement is impressed with public interest and any violations of the provision of this Letter-Agreement that may cause damage to the NFA or may suffer as a result of any breach, you shall be held responsible in accordance with the existing laws, presidential degrees, general orders, letter of instructions and other applicable rules and regulations;

IV. BASIS AND PLACE OF PAYMENT:

The basis for payment or service rendered shall be upon presentation of the general voucher together with trip tickets signed by the dispatcher ad certified correct by the Assistant Provincial Manager of ______________________ or any representative authorized to sign the same. Payments for services rendered shall be payable in check/s encashable at any Land Bank/PNB banks and which shall be made at the NFA.

Should you find the foregoing terms acceptable, please signify your conformity by signing on the conforme portion of this Letter-Agreement.
