A.
The Different Retirement Laws
1.
Retirement Under RA 1616 or the Gratuity Retirement Benefit
a. Qualifications for Retirement
Any employee who was employed prior to May 31, 1977 regardless of age and employment status provided he has rendered at least twenty (20) years of service, the last three (3) years of which are continuous (leaves of absences without pay during the last 3 years immediately preceding retirement shall not exceed 1 year) are qualified to retire under RA 1616.
b
.
Benefits
The retiree shall be entitled to the following benefits :
i.
Gratuity benefit equivalent to one month salary for each year of service for the first 20 years, one and one half months (1.5) salary for each year of service in excess of 20 up to 30 years, and two (2) months salary for each year of service over 30 years,
based on the highest salary rate received.
The last employer or office of the retiree shall pay the gratuity benefit.
ii.
Refund of retiree's personal contributions with interest and the corresponding government contributions without interest.

2.
Retirement Under RA 660 or the Annuity (Pension) Benefit Plan as amended
a.
Qualifications for Retirement
The applicant should meet the following conditions :
i.
he is a member of the GSIS Retirement Insurance Fund.
ii.
he has attained and/or completed the required age and length of service as indicated below :
AGE 52 53 54 55 56 57 58 59 60 61 63 64 65 or
SERVICE 35 34 33 32 31 30 28 26 24 22 18 16 15 over
iii.
his last three (3 ) years of service are continuous
iv.
leave of absences without pay during the last 3 years immediately preceding retirement shall not exceed one (1) year.
b.
Benefits
The retiree shall be entitled to annuity benefits computed as follows :
b.1. For age 57
The amount of monthly annuity (pension) shall be P30.00 plus 1.2 percent of each year of service rendered before June 16, 1951 and 2% for each year of service from June 16, 1951 of the average monthly salary received during the last three years prior to the date of retirement, but amount must not exceed 75% of average monthly salary.
b.2.
For other ages
The annuity shall be adjusted actuarially but the amount must not exceed 80% of the average monthly salary.

b.3. Types of Annuity Benefits
i.
Automatic Annuity - Pension is payable monthly guaranteed for five years from date of retirement. After the five-year period, payment of the monthly annuity benefit will continue if retiree is still living. It will automatically stop in case of death of the retiree.
ii.
Joint-Life Annuity - Payment of monthly pension benefit is also guaranteed for five years. In case of death of retiree or joint-life beneficiary after the five-year period, the annuity or pension shall be reduced to one half and paid to the survivor for life. Only the legitimate spouse can be a joint-life beneficiary.
iii.
Straight-Life Annuity - Payable monthly only for as long as the retiree lives; payment stops immediately upon death.
iv.
Five-year Lump sum - This is available only to those who are at least 63 years of age or over on the date of retirement. After five years if still living, retiree will be paid monthly annuity for life.
v.
Initial three-year Lump sum
- This is available to those who are at least 60 years of age or over on the date of retirement. The subsequent two-year lump sum shall be paid to retiree on his 63rd birthday. If after the five-year period, the retiree is still living, he will be paid the monthly annuity for life.
3.
Retirement Under RA 8291
a. Qualifications for Retirement
Any employee who has rendered at least 15 years of service, at least 60 years of age at time of retirement and who is not receiving a monthly benefit from permanent total disability.
b.
Benefit
Under the new law, a retiree has two (2) options:
i. The 5-year lump sum (60 X Basic Monthly Pension) plus the basic monthly pension for life starting at the end of the 5-year guaranteed period; or
ii. The cash payment (18 X Basic Monthly Pension) plus the basic monthly pension for life starting immediately upon retirement.

Under the law, separation benefits can also be availed with the following eligibility
requirements:
i.
A member who has rendered at least three (3) years but less than 15 years of service is eligible for separation benefit in the form of a cash payment equivalent to 100 % of the Average Monthly Compensation for every year of service payable upon reaching age 60 or upon separation, whichever comes later, if he is not receiving a monthly pension benefit from permanent total disability.
ii.
A member who has rendered at least 15 years service and who is below 60 years of age at time of resignation or separation is eligible for separation benefit in the form of a cash payment equivalent to 18 times the Basic Monthly Pension payable at time of separation plus the basic monthly pension for life starting at age 60.

B.
General Policies
1.
Applications for Retirement under RA 660 and RA 8291 shall be processed and paid directly by GSIS. However, it shall initially be filed at NFA for review and checking of requirements. Applications for retirement under RA 1616 shall be processed and paid by the NFA.
2.
Filing and processing of applications for retirement under RA 1616 of field office rank and file personnel shall be
decentralized to their respective field offices
. The application shall be indorsed by the Provincial Manager for the provincial employees and the Asst. Regional Manager for the regional employees and the application for retirement shall be approved by the Regional Manager. Likewise, processing of requirements under other retirement laws shall be decentralized to the provincial/regional offices prior to submission to its local GSIS offices.
3.
Application for retirement of Central Office officials and rank and file employees, field officials and Regional Administrative Officers (RAOs) shall be filed and processed at HRMD.
4. RAOs and Provincial Administrative Officers (PAOs) shall be primarily responsible for processing applications for retirement filed at the NFA provincial and regional offices respectively. They shall be trained on how to compute retirement gratuity benefits under RA 1616.
5. A retiring employee with stock accountabilities (e.g. Warehouse Supervisor) shall be relieved of his/her function six (6) months prior to his/her retirement to give him/her time to liquidate his/her accountabilities.
C.
Other Basic Information
1. All services of a GSIS member with any government office from the date of his employment whether full time and part time, and duly supported by documents, are creditable.
2. Retirement shall be compulsory for an employee at age sixty-five (65) with at least fifteen years of service. Any request for the extension of service of compulsory retirees to complete the fifteen (15) years service requirement for retirement shall be subject to CSC approval.
3. No person who has reached compulsory retirement age of sixty five (65) can be appointed to any position, except to primarily confidential position, provided that the appointment shall be under temporary status.
In some instances, services of an employee who has reached compulsory retirement age of sixty five (65) shall be extended for a period of six (6) months and shall be renewable for another six (6) months. However, services rendered during the period of extension shall not be credited as part of government service. Likewise, such extension shall not entitle the employee to leave credits and other benefits.(MC # 40, s 1998)
4. A member is not entitled to the old-age benefit if he has rendered less than three (3) years of service, or his separation from the service provides for forfeiture of the benefit.
5. In case of death, the designated beneficiaries/legal heirs/primary beneficiaries shall be entitled to receive death claim, funeral and survivorship benefits.
6. In case of accidental death, the designated beneficiaries/legal heirs shall receive the following additional benefits under the life insurance policy :
a. Double indemnity
b. Free Accidental Death Insurance
7. If a pensioner who has received a lump sum is re-employed, GSIS shall deduct the amount corresponding to the unexpired portions covered by the lump sum from the retirement benefits he will receive upon termination of his re-employment.
D.
Pre-Retirement Services to be Rendered by NFA
1.
The RAO/PAO of each NFA Regional/Provincial Office and the Administrative Assistant of each department in the Central Office shall generate a
List of Retirable Employees
(Exhibit 1) every year based on the personnel data available at their end. Basically, the listing will include employees who will reach the compulsory retirement age of 65 years for the following year. Other employees who have the intention to retire under any of the retirement laws shall notify their RAOs/PAOs/Administrative Officers/Administrative Assistants of such intention, on or before October 31 of each year, so their names could be included in the said list.
2.
The
List of Retirable NFA Officials and Employees
shall be forwarded by the PAO to the Regional Office and the Administrative Assistants to HRMD not later than November 30 of each year. The RAO shall prepare the
Consolidated List of Retirable NFA Officials and Employees
(Exhibit 2) which shall be submitted to HRMD not later than December 15 of each year.
3.
HRMD shall prepare an Annual Masterlist of Retirable Officials and Employees (Exhibit 3) which shall contain the names of retirable officials and employees from the Central and Field Offices. It shall furnish all departments and offices with a copy of the list to facilitate the issuance of clearances to the employees (with Addendum per
Circular No. 2000-85
signed by NFA Administrator EDNO Joson II dated July 26, 2000). The following offices shall immediately undertake their corresponding task as follows :
Department for Legal Affairs
- verifies records to check if any of the listed employee has a pending criminal/administrative case.
Internal Audit Services
- confirms if retirable employees who have been designated as accountable officers have fully liquidated their accountabilities and tolerable allowance on stock accountabilities has been computed.
Accounting Department
- verifies the financial accounts (money and stocks)/outstanding obligations of retiring employees.
General Services Department
- audit retiring employees’ records of property accountabilities.
HRMD
- checks if retiring employees who have service contracts with NFA have completed the required length of service and retrieves original copies of leave cards from Executive Assistants. Asks retired officials and employees to surrender their NFA IDs.
NFAEA
- verifies and certifies the outstanding accounts (money and facilities) of retiring employees with the use of a separate clearance form for this purpose.
For field offices, the counterpart section/unit of the above offices or departments shall perform the specified task.
4.
Provincial/Regional Offices shall also be given the Masterlist of Retirable Officials and Employees. Based on this list, the PAOs/RAOs of each province/region shall determine which employees are presently or have been previously assigned in their respective offices. The PAOs/RAOs shall also coordinate with the concerned sections/units on the issuance of clearances to the concerned employees.
5.
All offices which have been furnished with the said List of Retirables shall, then, notify retiring employees directly, copy furnished HRMD (for CO officials and rank and file employees , field officials and RAOs) and PAO/RAO (for field office rank and file employees), in case there are requirements which need to be settled prior to the issuance of clearance.
6.
Auditing of service records and perpetual leave cards of the following officials and employees shall be done by the following:
C.O. officials and rank and file employees - HRMD personnel
Field officials - HRMD personnel
RAOs - HRMD personnel
PAOs - RAOs
Provincial Office rank and file employees - PAOs
Regional Office rank and file employees - RAOs
As required under RA 1616, HRMD/PAOs/RAOs shall validate services rendered by retirees with the NFA and with other government agencies. Services rendered shall be fully supported with documents such as certified true copies of service records, Special Orders and Appointment papers, otherwise, such services shall not be credited. For those retirees under RA 660 and RA 8291, GSIS also validates services rendered by retiring employees so they are advised to keep their certified true copies of Special Orders, Appointment papers and Service Records for verification purposes.
7.
HRMD shall submit on or before December 30 of each year a copy of the List of Retirables and Summary Schedule of Retirement and Terminal Leave Benefits to the Budget Division (DTBFM) for purposes of funding allocation.
8.
HRMD/PAO/RAO shall provide retirable employees with a checklist of requirements for retirement and give counseling services as requested by the employees.
9. The PAOs shall submit a
List of Retired Officials and Employees
(Exhibit 4) to the Regional Office on or before January 15 of each year. The RAO shall consolidate the list and shall submit a
Regional List of Retired Officials and Employees
(Exhibit 5) to the Central Office - HRMD on or before January 15 of each year for updating of NFA plantilla.
E. Filing of Application for Retirement
1. The application for retirement shall be submitted at least one (1) month before the effective date of retirement to the following:
CO officials and rank and file employees - HRMD
Field Officials - HRMD
RAOs - HRMD
Provincial Rank and File Employees - PAOs
Regional Rank and File Employees - RAOs
2. The following documents shall be submitted in seven (7) copies each with the application for retirement/terminal leave:
a. Complete Statement of Service Record with dry seal
b. Certification of No Leave Without Pay from entrance to duty to the last day of service
c. Certificates of Clearance from Property and Money Accountabilities from all places of assignment including C.O. for field office officials (with Addendum per
Circular No. 2000-85
signed by NFA Administrator EDNO Joson II dated July 26-200)
d. Statement of Assets and Liabilities
e. Fiscal’s Clearance from Place of Residence
f. Recent Ombudsman Clearance
g. Latest Appointment/Special Order for Casual Services
h. Certification of Last Salary Received
I. Two (2) copies of recent 1 X 1 picture
j. Authority to Deduct for Loans and other Payables
k. Oath of Undertaking of Accounts by Accountable Officers with pending liquidation of accountabilities
l. Surety Bond from GSIS for employees/officials with pending case from Ombudsman
m. NOSA
n. GSIS Clearance (Form to be provided by GSIS)
o. Certification of collection or non-collection of gratuity benefits from previous employer
3. For retirement under RA 660 and RA 8291, the NFA authorized officer with specimen signature at GSIS shall endorse the Application of Retirement/Survivorship Benefit (GSIS prescribed form) with the following documentary requirements to GSIS Head Office or to the local GSIS offices for field offices, not more than two (2) weeks after the effective date of retirement :
a. Application for Retirement duly accomplished and properly endorsed by the Head of Office or authorized official. For retiring C.O. officials and rank and file employees, field officials and RAOs, the indorsing official shall be the Administrator and for field office rank and file employees, the Regional Manager.
b. Complete Service Record certified correct by the HRMD Department Manager for C.O. officials and rank and file employees, field officials, RAOs and by the Provincial Manager or Regional Manager, for field office rank and file employees. Certified true copies of SO’s and appointment papers shall be attached to the Service Record.
c. NFA Certificate of Clearance (with Addendum per
Circular No. 2000-85
signed by NFA Administrator EDNO Joson II dated July 26, 2000).
d. Statement of Assets and Liabilities
e. Recent Ombudsman Clearance
f. Certification of No Leave of Absence Without Pay (LAWOP) from entrance to duty to last day in service.
g. Latest NOSA/NOSI
4. In cases of deceased retirees, or when a GSIS member dies, the beneficiaries and/or legal heirs shall submit, in addition to a complete statement of service record of the deceased, the following requirements :
a. Death certificate of member or retiree *
b. Birth Certificate of children of deceased member/retiree *
c. Marriage contract of member. If he/she died single, his/her birth certificate. *
d. Proofs of surviving legal heirs/guardianship **
e. Bond of indemnity (if share of minor is more than P 50,000) **
f. Such other requirements as may be needed in certain cases

5. Officials and employees who were determined to be qualified to retire under RA 1616 shall submit to HRMD-PBU/PAO/RAO an
Application for Retirement
(Exhibit 6 for C.O. officials and employees, F.O. officials and RAOs and
Exhibit 6.1 for F.O. rank and file employees
) duly accomplished and properly indorsed by the authorized official. For retiring C.O. officials and rank and file employees, field officials and RAOs, the indorsing official shall be the HRMD Department Manager, for field office rank and file employees, the Provincial Manager or Asst. Regional Manager.
a.
Application for retirement under RA 1616 of C.O. officials and rank and file employees, field officials and RAOs shall be submitted directly to HRMD-PBU for processing. For Field office rank and file employees, same shall be submitted to PAOs or RAOs.
b.
The HRMD-PBU/PAOs/RAOs shall review the documents submitted by the retiring employees. They shall validate the number of years of services and the highest salary received against the supporting documents. If in order, the original copy of Application for Retirement shall be indorsed by the following officials together with the original and certified photo copies of all the documents to the NFA Administrator/Regional Manager.

c.
The HRMD-PBU shall compute for the gratuity benefits of the retiring C.O. officials and rank and file employees, field officials and RAOs. In the case of field office rank and file employees, the PAOs shall compute for the gratuity benefits and shall forward the papers to RAOs for review of computation.
d.
HRMD-PBU/RAO shall prepare the Adjudication Sheet (
Exhibit 7 for C.O. officials and employees, field officials and RAOs
) and
Exhibit 7.1 for field office rank and file employees
) and the Application for Retirement together with the complete supporting documents to the NFA Administrator/Regional Manager for approval.
e.
The Regional Office shall return the approved Adjudication to the originating province to support the request for remittance of funds.
F. Updating of Retirement Documents
1. Service Records
a.
HRMD-DMS shall prepare updated service records of NFA C.O. officials and rank and file employees, field officials and RAOs. Likewise, the PAOs/RAOs shall prepare updated service records of field rank and file employees. This shall cover the complete history of employment, i.e., period of service and office/agency where such was rendered duly certified by authorized officials whose specimen signatures are filed with GSIS. All duly authenticated service records shall be impressed with a dry seal.
b.
Such updating shall include services of elective officials whose service records shall be prepared by the Personnel Officer or its equivalent position in the local government unit, duly certified by authorized local official concerned. A COMELEC certification or oath of office may be submitted as supporting document.
c.
The preparation/updating of service records of NFA employees to include previous employment or service in another government agency or agencies shall be the responsibility of HRMD-DMS/PAO/RAO. If such records are not available, the employee concerned shall submit to HRMD-DMS/PAO/RAO all records of his/her previous government service duly authenticated by the Personnel and/or Administrative Officer of his previous offices or agencies.
d.
Copies of appointments or notices of salary adjustments duly certified by the Personnel Officer/Administrative Officer of the agency concerned may be submitted in lieu of the service records for previous employment if such are not available/obtainable.
e.
For retirees under RA 660 and RA 8291, original copies of all updated service records in the original form shall be submitted to the Government Service Insurance System (GSIS). For retirees under RA 1616, only the authenticated service records shall be submitted to GSIS for cash surrender value and refund of premium.
f.
HRMD-DMS/PAO/RAO shall annually update all service records.
2. Accountability and Other Documents
a.
Accountability documents shall refer to records of all money and property accountabilities and other responsibilities for which an employee is liable or answerable upon separation from the service . These may be in the form of loans, membership fees, cash advances (including travel expenses), and other legal dues supported by the necessary receipts and/or memorandum receipts in the case of equipment, motor vehicles, office furniture and other materials issued to an employee.
b.
Updating of such records shall be done as may be needed and shall be the responsibility of both the employee concerned and the unit involved in the transactions and in the maintenance of said records. A summary report, however, shall be made by the unit concerned, e.g., Accounting for money accountabilities and Property for property accountabilities, at the end of the year.
3. Other Documentary Requirements for Retirement
a.
The Finance Section in the field office shall furnish the retiree a Certification of Last Salary Received.
b. The Certification of No Leave Without Pay from entrance to duty to last day in service shall be prepared by the following:
C.O. and F.O. officials - HRMD - PBU
C.O. rank and file employees - Administrative Assistant
Provincial. rank and file employees - PAO
Regional rank and file employees - RAO
G. Validation of Services Rendered
1.
In validating services rendered, HRMD-PBU/PAOs/RAOs shall be guided by the existing laws, rules and regulations followed by GSIS in determining creditable services for retirement purposes which are as follows :
a.
All previous services rendered by an official/employee pursuant to a duly approved appointment, including those of Presidential appointee, to a position or pay whether on permanent, temporary, emergency, substitute, or casual status, and whether paid monthly, daily or hourly, subject to these conditions:
a.1. The services are supported by appointments duly approved by the Civil Service Commission (except those of Presidential appointees), official records and/or other competent evidence which GSIS/NFA may require in case of doubt/discrepancies.
a.2. Said services are on full-time or part-time basis, of which the three (3) years immediately before retirement are continuous.
b.
The period during which an employee is on official leave of absence with pay.
c.
The period during which an official/employee was on an authorized sick leave of absence without pay provided that it shall not exceed one year in a single instance, except in the case of teachers who are allowed three (3) years of sick leave without pay.
d.
The period during which an official/employee was out of the service as a result of an illegal termination of his services as finally decided by the proper authorities, provided the official/employee concerned was paid for the said period.
e.
The period of active service in the military of reserve officers and enlisted men who were integrated in the regular force of the Armed Forces of the Philippines but were honorably discharged or separated from the military service without receiving any benefits under RA 340, as amended, or other retirement laws covering military personnel, as duly certified to by the Armed Forces of the Philippines.
f.
Period of cadetship in the Philippine Military Academy.
g.
Period of cadet training and training for a commission in the reserve force of the Armed Forces of the Philippines.
h.
Period of student-assistanship, with compensation in state-owned colleges and universities pursuant to a valid appointment.
i.
The period during which an official/employee was in the service of an international organization and/or foreign government, in compliance with an international commitment of the Philippine Government, provided that the salary received from the foreign government or international organization with which the Philippines has a commitment/agreement shall not be considered in computing the money value of the employee's retirement benefit.
j.
Period during which an employee is on authorized study leave with pay.
4.
The HRMD/PAOs/RAOs shall be held liable for any certification made without appropriate basis or for any false statement and misrepresentation of facts in certifying services rendered.
H.
Payment of Retirement Benefits
1.
Gratuity Benefits
a.
All retirement applications under RA 660 and RA 8291 are processed and paid by GSIS. Gratuity benefits of retirees under RA 1616 shall be processed and paid by the NFA.
b.
Within fifteen (15) days from approval of the adjudication by the Administrator, retiring C.O. officials and rank and file employees, field officials and RAOs under RA 1616 shall be paid their gratuity benefits. Within this period, HRMD-PBU shall prepare the voucher, the Department of Accounting Services (DAS) shall process it, and the Department of Treasury, Budget and Fund management (DTBFM) shall prepare and release the check to the retiree.
c.
Processing of payment of gratuity benefits of NFA field office rank and file employees retiring under RA 1616 shall be decentralized at the NFA Provincial Office for provincial rank and file employees and to the Regional Office for regional rank and file employees. The Provincial/Regional Office shall request for the remittance of funds from the NFA Central Office upon approval of the Adjudication. Payment of gratuity benefits to the retirees in field offices shall be made within fifteen (15) days from approval of adjudication.
2.
Cash Surrender Value of GSIS Policy
The HRMD-PBU/PAO/RAO shall prepare the claim for the Cash Surrender Value of the retiree’s GSIS policy. The following requirements, duly authenticated by NFA, shall support the claim:
a.

Service Record
c.
Certification of no leave without pay
d.
Cash Surrender Value Form
e.
Policy Contract
3.
Refund of Premium (for retirees under RA 1616 only)
The refund of premium which includes the employee’s share with interest together with the employer’s share without interest shall be paid to the retirees by the GSIS upon submission of the following documents duly authenticated by NFA:
a.
Copy of GSIS Adjudication
b.
Statement of Salary Loan Account
c.
NFA Clearances
d.
Service Record
e.
Certificate of No Leave Without Pay
f.
Statement of Assets and Liabilities
g.
Ombudsman Clearance
4.
Terminal Leave Benefits
a.
Retiring C.O. officials and rank and file employees, field officials and RAOs shall file their Application for Leave of Absence (ALA) for purpose of collecting terminal leave benefits to HRMD-PBU The application shall be supported by the original copy of his/her perperual leave card (PLCs), and GSIS Clearance.
b.
For Provincial Office retirees, the requirements shall be submitted to their respective PAOs who shall ensure that the requirements are complete before indorsing them to Regional Office. The RAO shall countercheck the requirements before submitting the application to the Regional Manager for approval.
c. In cases where Perpetual Leave Cards (PLCs) are Lacking, the following procedures
shall be applied :
c.1 In case of loss or incomplete perpetual leave cards (PLCs), the RAO/PAO/Executive Asst. I shall reconstruct said PLCs provided these are supported by source documents such as Daily Time Records/Timecards and Service Records duly attested by the Head of Office/Department Manager concerned.
c.2 If the reason, however, of the loss is due to natural calamities (typhoons, floods, earthquakes, fires), a certification by the Head of Office/Department duly notarized must be submitted stating why such PLCs cannot be submitted.
d. The original copy of the perpetual leave card shall be duly closed as of the last day of service and certified correct by the Administrative Assistants for C.O. rank and file employees, by the PAOs/RAOs for field office rank and file employees and by the HRMD-PBU for NFA officials. Same shall be noted by the concerned head of the departments/offices.
e. HRMD-PBU/PAO/RAO shall audit the leave cards as to the completeness and correctness of entries. They shall also compute for the money value of the leave credits and the HRMD-PBU and RAO shall prepare the voucher for the claim.
f.
Computation of Terminal Leave Benefits :
The terminal leave benefits shall be computed as follows :

g. Head of Offices/Department Heads and their Administrative Officers/Administrative Assistants shall be held responsible for any payment of terminal leave benefits not in accordance with the provisions of pertinent laws, rules and regulations.
5.
Pag-ibig Fund Provident Benefits
a.
A retiree may file an application for Provident Benefits with the Pag-ibig Fund. It shall consist of his Total/Member Accumulated Value which includes his personal contributions to the Fund, his employer's counterpart contributions and all the fixed and variable dividends earnings of the total contributions. When membership is terminated by death, an additional benefit shall be granted to the beneficiary.
b. To apply for Provident Benefits, the claimant shall :
i.
Secure an application for Provident Benefits (HDMF 430-88-1) from any Pag-ibig NCR Branch or any Pag-ibig Regional or Extension Office.
ii.
Accomplish the application form in duplicate. (For regional applications, in triplicate).
iii.
Together with the application form, the retiree shall submit the following documents :
Certificate of Remittance (HDMF 430-83-1)
Service Record (for national government employee)
Certified True Copy of Member's Birth Certificate
GSIS Retirement Approval/Retirement Voucher
iv .
For claims of Provident Benefits because of death, the following shall be submitted
in addition to
b.iii above.
Special Power of Attorney (HDMF 620-10-1)
Affidavit of Guardianship (HDMF 620-08-1) for minor children
Certified True Copy of Death Certificate issued by local Civil Registrar
Proofs of Surviving Legal Heirs (HDMF 620-09-1)
Certified true copy of member's marriage contract/certificate issued by local registrar, if member is married.
In cases where photocopies are submitted, the original copy must be presented for comparison or authentication. Falsification of documents or any untruthful statements made therein shall be a basis for disapproval of the application.
v.
Submit complete application form, together with the required documents to any Pag-ibig-NCR Branch or any Pag-ibig Regional or Extension Office. Processing of claims will commence only upon submission of complete documents.
vi.
Await notice of the availability of check from Pag-ibig-NCR Branch or from the Regional Office where the application was filed.
vii.
The benefits shall be paid directly to the member, or any authorized representative. In the event of death of a member, payment shall be made to his beneficiary/ies or the latter's guardian/s authorized representative or any duly appointed court administrator or executor.
I.
Benefits Granted to Beneficiaries of Deceased Retirees
In case of death of a retiree under RA 1616, the beneficiaries are entitled to the following:
1.
Gratuity Benefits (to be paid by NFA)
2.
Refund of Premium (GSIS)
3.
Funeral Benefits (GSIS)
4.
Death Claim (GSIS)
5.
Employees Compensation Claim (ECC) - For work connected death, payment of funeral benefit
6.
Pag-ibig Provident Benefits (Funeral Benefits and refund of contribution)
7.
Terminal Leave (NFA)
J. Retiring Employees with Unliquidated Stock and MTS Accountabilities
A retiring employee who has unliquidated stock and MTS accountabilities shall not be issued a Certificate of Clearance until such time his/her accountabilities has been fully liquidated and settled.
K. Retiring Employees with no Money and Property Accountability but with Pending Administrative and/or Criminal Case with the Ombudsman and other Courts
A retiring employee with no money and property accountability but with a pending administrative and or criminal case with the NFA and or with Ombudsman and other Courts (e.g. regular courts or Sandiganbayan for grade 27 and up) shall be issued a clearance by DLA with a notation that the retiring employee has pending administrative/criminal case with the NFA, the Ombudsman and other Courts,
ONLY AFTER
the employee secures from GSIS a Surety Bond in favor of NFA, which shall restitute, in the event that he is found guilty, any and all amounts representing retirement benefits that may have been released to him by NFA during the pendency of the criminal or administrative case.
L. Retiring Employees with Money and Property Accountability and with Pending Administrative and/or Criminal Case with the Ombudsman and other Courts when NFA is Properly Advised of the Pending of Criminal Case with the Ombudsman and or Other Courts
A retiring employee who has money and property accountability and with pending administrative and/or criminal case with the Ombudsman and other Courts when NFA is properly advised of the pending of criminal case with the Ombudsman and or Other Courts shall be issued a clearance by the DAS after the employee concerned submits an Affidavit of Undertaking obliging himself to pay and clear himself of his accountabilities.
Likewise, he/she shall be issued a clearance by DLA with a notation that the retiring employee has pending administrative/criminal case with the Ombudsman and other Courts,
ONLY AFTER
the employee secures from GSIS a Surety Bond in favor of NFA, which shall restitute, in the event that he is found guilty, any and all amounts representing retirement benefits that may have been released to him by NFA during the pendency of the criminal or administrative case.
M.
Retiring Employees Without Money and Property Accountability but with Pending Administrative Case with NFA
A retiring employee Without Money and Property Accountability but with Pending Administrative Case with NFA shall be issued a Certificate of Clearance by DLA but with a notation that he/she has a pending administrative case. (For the meantime, the release of retirement benefits shall be held in abeyance pending resolution of his administrative case which release will be dependent on the outcome of such case). In the event that he is found guilty , any and all amounts representing retirement benefits and terminal pay due to him shall be forfeited in favor of the government.
All rulings and/or issuances inconsistent with the provision stated herein are hereby superseded.
This SOP shall take effect on the 17th day of March 2000.
