CONTRACT OF SERVICES (Exh. 13)


KNOW ALL MEN BY THESE PRESENTS :

This contract of services is entered into by and between:

The NATIONAL FOOD AUTHORITY, an agency of the government created pursuant to Presidential Decree No. 4 as amended with principal office at 101 Matimyas Bldg. E. Rodriguez Avenue, Quezon City, duly represented herein by its Regional Manager/Provincial Manager, hereinafter referred to as the PARTY OF THE FIRST PART.

and

Mr/Miss ____________________________________ of legal age, Filipino, single/married with residence and postal address at __________________________, Philippines hereinafter referred to as PARTY OF THE SECOND PART.
W I T N E S S E T H

WHEREAS, the PARTY OF THE FIRST PART needs the service of the PARTY OF THE SECOND PART to ensure and facilitate effective implementation of the Local Food Security Project uner the Farmers Alleviation Program of the Lingap Para sa Mahihirap Program in the province of _______________ ;

WHEREAS, the PARTY OF THE SECOND PART signified his intention to provide the needed services to facilitate effective implementation of the Local Food Security Project ;

WHEREAS, this CONTRACT is not covered by the Civil Service Law Rules and Regulations but subject to existing COA rules ;

WHEREAS, the PARTY OF THE SECOND PART shall not enjoy the benefits being extended to government employees, such as PERA, COLA AND RATA per CSC-MC No. 38 s., 1993 ;

WHEREAS, the services of the PARTY OF THE SECOND PART are not considered government services to be submitted to the CSC for approval/attestation ;

WHEREAS, this contract does not establish an employer-employee relationship between the PARTY OF THE FIRST PART and the PARTY OF THE SECOND PART ;

WHEREAS, this Contract is executed in accordance with the guidelines on hiring of workers under Contract of Services/Job Order basis pursuant to Rule XI of the CSC-MC No. 40's of 1998 ;

WHEREAS, the PARTY OF THE FIRST PARTY agrees to hire the PARTY OF THE SECOND PART as Production Aide in the implementation of the Local Food Security Project under the Farmers Alleviation Program of the Lingap Para sa Mahihirap Program for a period of five (5) months and the PARTY OF THE SECOND PART agrees thereto effective _________________ to _______________, unless sooner terminated by NFA at its option under the following terms and conditions :

I. OBLIGATIONS OF THE PARTY OF THE FIRST PART:

To pay the PARTY OF THE SECOND PART the amount of PhP 200.00* per eight (8) hours day of work prescribed under Memorandum Circular # AO-99-11001 dated October 22, 1999.

II. OBLIGATIONS OF THE PARTY OF THE SECOND PART:

General:

To assist the PMDO/LFS Coordinator i the effective implementation of the Lingap Para sa Mahihirap Program-Local Food Security Project in the province.

Specific:

To provide technical assistance to Farmer-Beneficiaries of the LFS Project during the conduct of POT, seedling preparation, transplanting, irrigation, fertilizer application, pest and disease management, harvesting and post-harvest operation based on the Schedule of Farm Activities.

1. To assist the FB's in the preparation of monthly Farm Operations Reports.

2. To gather pertinent data/observations relevant to the LFS project and make recommendations.

3. Assist the PMDO/LFS coordinator in the selection of Outstanding LFS Beneficiaries.

4. To assist the PMDO/LFS coordinator in updating the FB's index cards in preparation of the LFS Monthly Reports and Terminal Report.
