MEMORANDUM OF AGREEMENT

This Memorandum of Agreement entered into this ____________ day of _____________, 19__ in ___________________________ by and between:

___________________________________, a farmer’s organization duly registered with _________________________________, with office address at ___________________, hereinafter referred to as “______________________________________”;


The NATIONAL FOOD AUTHORITY , a government agency created pursuant to Presidential Decree No. 1435, with office at _______________________________________
_____________________________ represented in this Act by its Manager, ______________
______________________________________, hereinafter referred to as "NFA" .


WITNESSETH:

WHEREAS, NFA, thrust towards stabilizing the grains industry involves a number of programs that will enhance the farmers productivity and marketing of their produce ;

WHEREAS, the _____________________, a farmer’s organization with _______________________________ farmer- members, engaged in the production of palay / corn, plans to improved / uplift the lives of its members by availing of the incentives / programs of NFA;

WHEREAS, the NFA embarked on giving incentives to farmers who sell their produce to NFA, one of which is the Cooperative Development Incentive Fund program wherein a monetary incentive for the sale of the farmers ‘ produce is granted to them for the acquisition / or rental of Post Harvest Facilities (PHF) ; as subsidy for the training expenses of the farmer’s organization, acquisition / purchased of production facilities and inputs ; and investments / equity in Area Marketing and Bank Cooperatives.

NOW , THEREFORE , on the basis of the foregoing premises, the parties hereby agree as follows :

ARTICLE I

1. The parties hereto agree that this Memorandum of Agreement shall cover the coordinated activities of the parties in the granting / utilization of the Cooperative Development Incentive Find (CDIF) .

ARTICLE II

ROLES AND RESPONSIBILITIES OF THE PARTIES

2. The parties shall specifically undertake the following:

2.1 The ____________________________________ shall :

a. Utilize their CDIF in the amount of P ________________, only for the following purpose as stated in thier written application for withdrawal : (e.g. - purchase of thresher )

b. Provide NFA with pertinent data / information regarding the utilization of their CDIF funded PHF ; and

c. Inform all farmer - members of the acquired CDIF funded PHF.

Properly maintain and operate the CDIF funded PHF for the benefit of its members.

2.2 The NFA shall :

a. Immediately release the CDIF of _________________________ requirement have been complied of :

b. Evaluate the utilization of the CDIF funded PHF of the ___________ _______________________; and

c. Assist the _____________________ with the problems encounters relative to the CDIF funded PHF.

d. Inform the farmer organization that their accumulated CDIF shall be considered inactive when they show no transaction for a period of two (2) years and that it shall be forfeited in favor of NFA.

ARTICLE III

This MOA shall take effect upon signing hereof, and shall continue to be in full force and effect for a period of ___________________________.

The parties further agree to initially adopt the implementing rules and regulations of the SOP on Cooperative Development Incentive fund CDIF in order to effectively implement the provision of the MOA.
